According to an interview, on site, on April 9, 2013, conducted by Nick Panchev, the followings has transpired:
Q. by Nick: Am I correct that you are sent by PG&E to find tortoises, ground squirrels, endangered species and
possibly crocodiles in the Town of Hinkley, CA ?
A. By the "scouts playing being biologists" - the photo to left:  Yes, there should be many tortoises, ground squirrels.... 
Q. by Nick: So, if you bring all such species from other locations, PG&E do not have to further conduct any clean-up of
any toxins ?
A. By the "scouts playing being biologists": Oooh...., you mean that there are no tortoises in Hinkley, CA and we are.....

Nick's statement in conclusion: You are young, you are being used, you have the whole life in front of you, so I do not
want to lump you in the CRIMINAL INVESTIGATION and in the subsequent CRIMINAL COMPLAINTS and ruing your life.
There are no tortoises, or any other endangered species in Hinkley, CA.  If the Hinkley folks has died in record numbers, 
so as all of these tiny creature, dead by multi - toxins - poisoned.  It is for your own good to GET OUT OF HINKLEY, CA.


April 9, 2013 - - 911 Call
 


PG&E Contractors were asked to get out of owner's property and upon entry, the Sheriff, County of San Bernardino was
dispatched on 911 Call. Short of imminent confrontation, due to entering the private property the Sheriff arrived in absolute
short time, (Sheriffs overseeing Hinkley, are very informed and construed as one of the best) and made a Police Report. 
Again, Nick ask the contractors for PG&E to exhibit any Court Order, or any Warrant, stipulating entry into the private
property. Those contractors did not had such. Shortly, the property owner arrived, being the client of THE PEOPLE OF
Hinkley's organization and praised the organization's paralegal and investigators for performing the best for the client.
NOTICE TO LAHONTAN WATER BOARD:  In the absence of due process of law (court warrants to enter) entering in
private properties is not only construed as trespassing but in fact it is a criminal offense [FELONY].
No other methodology, particularly if above the law, will survive in any judicial venues. No other authorization is now valid.
All entry, inside of our client's properties, must be by a court order, which will endlessly be appealed if on the contrary.

RESTRAINING DEMAND    AT-ISSUE: IS CALTRANS IN COLLUSION WITH PACIFIC GAS AND ELECTRIC COMPANY?
Nick Panchev, Director THE PEOPLE OF HINKLEY organization, has discussed Restraining Demand upon CALTRANS
with Neil H. Brown, Attorney for CalTrans, 100 S. Main St, Suite 100, Los Angeles, CA 90012, Tel (213) 687-6000
in
regards to the followings:

1. David G. Adams, ROW agent from CalTrans and other staff, shall immediately cease intruding into the People from
the town of Hinkley real estate private properties, staking and flagging within, an "Illusionary Highway 58 Expansion"
being a mile wide, whereas there is no such huge highway, a mile wide in the World, but only happens in Hinkley, CA,
sufficient to foster landing of 50 B52 Jets, at the same time, particularly in the absence of an executed and recorded
LEGAL IMMINENT DOMAIN, not limited to all appeals available in the Appelate Courts to the private property's owners. 
 
2. Thereafter the tone of such initial conversation went down, the following was stated in a more rational way, to wit:
Alleged was that PG&E was using CalTrans to purchase real properties under the doctrine of Imminent Domain, at an extremely low prices, absent of the Water Rights, now pending massive litigation, and subsequently flip it to PG&E,
thus PG&E dos not have to pay for the Takings of Water Rights Without Just Compensation, in pending filings lawsuit. 

Such acts are not only construed as fraudulent, unscrupulous,
conspiring and co-conspiring acts; misrepresentation;
abuse of power; conflict of interest; corruption, but a Criminal Offense (FELONY).

3. WHEREAS, Nick Panchev did review, at great length the drawings, maps, several options and specifically the EIR,
being an engineer as well, and concluded that the proposed widening to 4 lanes, so termed "Superhighway only needs
a maximum of 100 ROW and even with Hinkley and Lenwood Roads interchange, to a max of 300 feet and not a mile.

Scarring the People of Hinkley, by such ultra manipulative acts, can cost CalTrans the lost of huge Federal Hwy Funds.

It is time for CalTrans to really assess its position and apologize to the People of and from Hinkley, CA, the ones alive.
"It only happens in Hinkley, California USA"  The town where many Government Agencies has exhibited corrupted act.

As you are aware, ground waters (the only source of whole house water), soils and air, at all Real Properties

in the town of Hinkley, San Bernardino County, California, were poisoned decades ago with many substances

containing grave toxic chemicals, constituent toxins and due to decay resulted there form such byproducts,

also poisoned with Uranium and subjected to measurable and life threatening levels of beta radio nucley activity.

[MASSIVE TOXIC TORT]


As many residents has died, are dying, and become severely ill with myriad of diseases from such massive

poisoning, no one is, nor will ever purchase, sale, or hold real property in such a ghost town, thus the

ASSESSED VALUE WAS AND IS AT ZERO DOLLAR, at all times, for the past 50 years and indefinitely.

Dennis Draeger, County of San Bernardino Assessor, his Appraisers and staff have failed to comply with the

obligation to re-assess all real properties in said town, for over 50 years, at ZERO VALUE, based upon these

substantial and extreme evidentiary facts.

How many more lawsuits, in addition to the $333 million dollars (Anderson) Erin Brockovich case have to be
considered in order to establish precedence, not limited to of how many more dead folks in said town, now down
to minuscule 1615, to prove that all real properties have zero value, cannot be sold absent of lawsuit for selling
poisoned real property, and are nothing more than an absolute waste land and/or properties in a ghost town,
destroyed by Pacific Gas and Electric Company (PG&E Corporation) ?

WHEREFORE, this demand for refund of taxes paid for four years, (four years statute of limitation's time frame)
to each and every real property owner, sponsored by THE PEOPLE OF HINKLEY, shall serve as the INFINITE

and FINAL 30 DAYS NOTICE, prior to filing of a lawsuit.

Unless the absolute minimum aggregate refund of Two Hundred Eighty Tree Thousand and Two Hundred

Eighty Dollars, ($283,280), involving One Hundred Sixty Nine (169) Real Properties, within the town of Hinkley,

County of San Bernardino, CA is promptly made, legal action will be taken necessary and appropriate to collect

this aggregate sum.


Furthermore, the purpose of this final demand for refund is to give you the opportunity to resolve and settle this

matter without the added cost that will result from costly lawsuit, not limited to all other civil, administrative

and criminal action's costs.  


As you are further aware, the U.S. Supreme Court has ruled on Property Rights, wherefore any one from said
town is entitled to proceed with direct lawsuit against the County, without being subjected to appeal before the
California State Board of Equalization. (Set precedence, whereas Citizens can litigate in judicial venue in
lieu of an appeal before any Federal, State and Local Boards, thus any prerequisite administrative remedy
can be set-aside.)

Should you fail to respond to this demand letter, or in any other manner indicate your refusal to resolve this
matter, you will leave no alternative but for us to seek legal recourse against you.

We cannot impress upon you too strongly the urgency of refunding the aggregate sum of $283,280 in order to
avoid filing of a lawsuit, in 30-days from above date. [Lawsuit is only a partial remedy. We will initiate full and
unconditional Investigatory of all transpired events].

Be assured that we intend to vigorously pursue refund of said sum, inclusive of the retroactive re-assessment,
as of December 2008, of the real properties in the town of Hinkley, County of San Bernardino, California.

and beyond.  WHEREAS, 159 real properties in the town of Hinkley, CA 92347 are poisoned,

(evidentiary setting precedence) triggering the Doctrine of Takings Without Just Compensation. 

 

You have failed to comply with your payment obligation to each and every property owner, holding title to

these 159 real properties in Hinkley, CA 92347.

WHEREFORE, this demand for payment, to each and every property owner, sponsored by

THE PEOPLE OF HINKLEY, shall serve as the FINAL 30 DAYS NOTICE, prior to filing of a lawsuit.

Unless full payment is promptly made, legal action will be taken necessary and appropriate to collect this

1. INVESTIGATIVE COMPLAINT No.1:
Utmost failure to impose the appropriate penalty on Discharger PG&E, in the minimum punitive amount of over Nine Million
Dollars ($9,000,000 +) (25 years of violation on CAO's at the minimum penalty per day of $1,000), whereas, said Board's
staff did only imposed $3.6 million penalty, in lieu of $9 million+, inclusive of only accepting $1.8 million, as settlement,
resulting loss to the State of California of over $7.3 million, and triggering collusion issue, at-issue, and/or favoring special
interest issue, at-issue, in favor of PG&E Corporation, with bias against The People of Hinkley, the People of this State.
2. INVESTIGATIVE COMPLAINT No.2:
Utmost failure to disclose facts, (alleged as intentional) such as the town of Hinkley, CA is not only poisoned by the
Discharger PG&E with the Toxic Chemical Chromium, but with at least 6 other toxic chemicals, inclusive of Manganese,
Arsenic, Nitrate-Nitrite, Sodium (Hydroxide constituent, Uranium, and not limited to Radionuclides Gross Beta radiation,
triggering THE PEOPLE OF HINKLEY to file INVESTIGATIVE COMPLAINT for concealment of facts, which could further
trigger the doctrine of Government Cover Up before Jury Trial in appropriate judicial venue, Lahontan Water Board as
Respondent, causing loss of funds by the State of California.
3. INVESTIGATIVE COMPLAINT No. 3:
Violation of Bagley-Keene Open Meeting Act, whereas the Board's staff conducted work shop, absent of public participation
and comments, leading to canceled Public Meeting, triggering loss of State revenue.
4. INVESTIGATIVE COMPLAINT No. 4:
In conducting Public Hearings, the Board's Staff has allowed private company (PG&E) to utilize taxpayers' facility (Hinkley Elementary School) without taxpayers approval, multi occurrences, inclusive of failure to seek the appropriate
compensatory for such usage, wherefore causing loss of revenue to the State of California.
5. INVESTIGATIVE COMPLAINT No. 5:

WHEREAS, despite numerous complaints, the Board's attorney has exhibited manipulative acts, all in an effort to deter
The People of Hinkley, who were  seeking refund of real property taxes, based upon Zero Value Real Property, due to
massive poisoning calamity's sustained during the Four Years Statute of Limitation (Since 2009), thus illegally protecting
the acts of the County' Assessor and his appraiser, alleged as corrupted and fraudulent.
WHEREFORE, based upon prior Superior Court Case, the Discharger PG&E admitted liability for poisoning the Town of
Hinkley ground waters with Chromium and had agree to pay settlement in the amount of $333 million, thus such action has
set precedence, which the Board's attorney has intentionally neglected to consider and therefore has caused
unprecedented loss and sufferings - mass tort to the People of this State. (Sustained loss and injury, that can trigger the Board's attorney of being in a position of Respondent in judicial venue, causing substantial monetary loss to the State of California.

AT-ISSUE No. 1:
It is proven that the chemical Hexavalent Chromium or Chromium VI (Cr6+) is generally produced by industrial
processes. (Another expression of Sodium Metaborate 4 mol or mol 8.)

We are alleging that PG&E has also used Sodium Metaborate  4 mol / 8 mol for rust protection of their cooling tower
at Hinkley’s facility, in addition to Cr6+, at the existing Ponds No. 6 and 7, being in addition to contamination of ground
water from Pond No. 8 with Cr6+. It is also alleged that in Ponds 4 and 5 PG&E has discharged Manganese and Arsenic.

To certify a Negative Declaration for PG&E, in regards to use of the existing Ponds No. 6 and 7 and construct on top of
such Ponds No. 6R and 7R, not limited to construct such pond within the boundary of the PG&E’s facility in Hinkley,
CA, will destroy evidentiary exhibit, thus your action to certify will be in direct collusion to CEQA mandates, other
regulations and laws.

AT-ISSUE No. 2:

Common chemistry tells us that equivalents of reactants react in equal numbers to yield the equal equivalents of
products. [Emphasis added]

In addition to alleged herein above, it is hereby further alleged that the large amount of water that is stored at the Borax
(Rio Tinto Group) facility, Boron, CA, called watershed reservoirs and other craters full with water, has leached to the
aquifers in the Boron’s / Hinkley’s Valley and further contaminated ground waters with Borates-Boron and with
Sodium Metaborate mol 4/ mol 8, in addition to by PG&E.

Recent investigation of ground waters throughout Hinkley’s Valley has revealed that fact, not limited to that the
contamination of the ground waters in the Hinkley’s aquifers (upper and lower) is also caused by the Discharger Borax 
Rio Tinto Group, in addition to by the Discharger Pacific Gas and Electric Company (PG&E Corporation) with PG&E
being the Primary Discharger of the Toxic substances Chromium VI (Cr6+), Sodium Metaborate mol 4/ mol 8, et al. 

As to further and distinct contamination by the Discharger Pacific Gas and Electric Company (PG&E Corporation)
and Borax / Rio Tinto Group, all man introduced, of the ground waters, air and soils at Hinkley Valley, with the toxic
substances Manganese, Arsenic, Uranium, Nitrate / Nitrite, Sodium Fluoride, Boron / Borates, Borax, Boric Acid
Oxide, Sulfuric Acid, et al, thereafter the further and distinct discovery, has positioned the town of Hinkley, CA as the
“INFINITE TOXIC TRASH BOWL”, with over a dozen toxic substances We are currently conducting “undercover”

Article that appeared on page 1, July 30th, 1993, therein the Desert Dispatch newspaper and it was titled
"High levels of uranium found in Hinkley well."
"Hisam Baqai, supervising engineer for Lahontan Regional Water Quality
Control Board said he was not aware of the find." [The People of Hinkley are charging him and the Board with cover-up].

WHEREAS, the results of that testing -- which Mr. Baqai was keenly aware of -- conducted in August 1993 showed
varying unsafe levels of uranium present in groundwater throughout the Hinkley valley. [Findings Contributor John Coffey]

WHEREAS, Mohave Water Agency, knew as well, since that time, of all of these results, but remained mute, even now.

WHEREAS,
there were measurable levels of beta radio nuclei activity detected in every well tested in Hinkley, California.

WHEREAS, PG&E and Dennis Paustenbach, founder and president of ChemRisk

the first and and only CR6 (Chromium VI) study over 30 years ago, as alleged and confirmed by reliable sources. 

WHEREAS, thereafter 1992 and until 2007, study and tests for Chromium VI, dissolved Manganese, Arsenic, Sodium
Metaborate mol-4 and mol-8, decay of Uranium which released Gross Beta Radiation and Radon Gas,
that can lead
to huge civil and criminal liability, were destroyed as well, until recently when the State of California Lahontan Water
Board sensed their massive liability for Government cover-up, and had to seek reports from Excelchem Environmental
Labs

WHEREAS, for Total Chromium, it was reported at over 4,000 ug/L, being over 80 times the legal limit of 50 ug/L.


WHEREAS, the ongoing poisoning of the Hinjkley's residents for the past 50 years has yielded more than 30 dead and

more than 200 with deceases related to substantial diminished DNA immune system resistance, on population of 1600.


WHEREAS, Assessor Dennis Draeger and his Appraisers has disregarded laws, not limited to Proposition 65 Clean

Water Act, Clean Air Act, and many other Federal and State Acts, positioning themselves above the law and continued, 
thereafter 2007, to appraise/assess real property at dollar amount they feel like it, in lieu $0, thus defrauded the People.
WHEREAS, all Government Agencies must realize the magnitude of poisoned soils, air, water and People from Hinkley,

California, inclusive of cover-up and resulted therefrom deceased persons, that it could be construed as a felony.

The People of Hinkley has sent Cease and Desist Memorandum to Lisa Dernbach, from the CALIFORNIA WATER
BOARDS, Lahontan Regional Water Quality Control Board, demanding that

The Town of Hinkley, California was also poisoned, in addition to with 350 million gallons Chromium VI plume by PG&E,
Pacific Gas and Electric Company,
which was never cleaned up, nor it will ever be cleaned, with Uranium, being another
toxic metal, in addition to causing gross alpha and gross beta radiations, exceeding legal drinking water standards of
20 piccocuries per litter (pCi/L), 15 pCi/L, 50 pCi/L, respectively, construed as another life
threatening act by PG&E, by
letting many alfalfa fields of being irrigated with such toxic poisons. (Ongoing of wrongful / strict liability's acts by PG&E)

PG&E has known for many years, however concealed that fact and allowed many alfalfa fields to be irrigated with plume containing huge concentration of Chromium VI in the ground waters, Town of Hinkley, CA, which act caused disturbance
of the Uranium at the bedrock below the lower aquifer, thus bringing such disturbed uranium to the surface, by pumping
out, extracting and fraudulently diluting the Chromium VI, all in an effort to show substantial less ppb for Chromium VI.

the groundwater in their area by said defendant.And I have here, a list of 84 demurs,submitted by the representatives of
Pacific Gas and Electric, each one attacking and thereby rejecting the validity of these complaints. I have reviewed all
the information carefully. I am ready to give my decision.  Before I do, is there anything anyone wants to say? " NO.
"Very well...In the case of the claimants of Hinkley California vs. Pacific Gas and Electric, it is the judgement of this
court that each of the 84 demurs submitted by Pacific Gas and Electric be dismissed and the cause of action against
Pacific Gas and Electric be upheld..." " ...On a more personal note, as a resident here in Barstow, which is not
far from Hinkley, I am...appalled that, not only was Hexavalent Chromium used, but your clients actually sent these
residents pamphlets telling them it was good for them." (Therefore, PG&E's attempt to dismiss had failed.
SET PRECEDENCE.)


While PG&E's staff was observed to wear HAZMAT outfits, the People of Hinkley were dying in record numbers, there 
are massive lawsuits pending. Not for only poisoning the entire town of Hinkley for the past 50 years with Chromium VI,
but with toxic MANGANESE, confirmed to be also utilized, since 1960, for rust protection, dumped in another unlined
pond by PG&E's staff at their Hinkley's plant, which was not disclosed as well.  In addition to poisoning the entire town
of Hinkley with above mentioned ultra toxic poisons, by allowing uranium disturbance (uranium exist at most locations
in our planet) at the bedrock below the lower aquifer and by allowing, at their property, pumping-out of ground waters
to irrigate many alfalfa field, has caused reaction of the uranium by toxins, which in turn caused decays and exposure, 
above threshold limit, to Beta radiation and Radon Gas.    ALL HINKLEY'S RESIDENTS CAN EXPECT TO SOON DIE.
